These Terms and Conditions govern your use of the PaperCity Photography website. By using this website, submitting an inquiry, or making an online purchase or booking, you agree to these terms.

Website Information

Website content is provided for general informational purposes. Service descriptions, availability, examples, and prices may change without notice. Submitting an inquiry does not guarantee availability or create a photography or studio-rental agreement.

Photography and Studio-Rental Agreements

Photography services and studio rentals may require a separate written agreement, invoice, model release, or booking confirmation.

If these Website Terms conflict with a signed client or rental agreement, the signed agreement controls for that service.

Bookings and Payments

A date or time is not reserved until all stated booking requirements have been completed. Depending on the service, these requirements may include:

  • Signing the applicable agreement

  • Paying a retainer, deposit, rental fee, or invoice

  • Providing requested scheduling and contact information

  • Receiving confirmation from PaperCity Photography

Prices, payment schedules, cancellation rules, rescheduling rules, late fees, overtime charges, and refund eligibility are governed by the applicable booking page or written agreement.

Cancellations and Rescheduling

Cancellation, rescheduling, lateness, and no-show policies vary by service. Review the applicable booking page and agreement before making payment.

Weather-dependent outdoor sessions may be rescheduled when PaperCity Photography determines that conditions are unsafe or unsuitable. A preference for different weather or lighting does not automatically entitle a client to a refund.

Client Responsibilities

Clients and studio renters are responsible for:

  • Providing accurate contact and booking information

  • Arriving on time and prepared

  • Supervising their children, guests, and invitees

  • Following studio rules and safety instructions

  • Obtaining required permissions for locations, people, products, or property

  • Avoiding conduct that is unsafe, unlawful, abusive, or disruptive

  • Paying for damage caused by the client or the client’s guests, subject to applicable law and agreements

PaperCity Photography may stop or refuse services when conduct creates a safety risk, involves harassment, violates the law, or materially interferes with the work.

Creative Discretion

Photography is a creative service. Unless a written agreement states otherwise, PaperCity Photography retains reasonable professional and artistic discretion over lighting, composition, posing, selection, editing, color treatment, and final delivery.

Portfolio examples illustrate our style but do not guarantee that every session or event will produce identical results.

Delivery and Storage

Estimated delivery dates are not guarantees unless expressly stated in a signed agreement.

Clients are responsible for downloading and securely backing up delivered files before the gallery or download deadline. PaperCity Photography does not guarantee permanent storage after the retention period stated in the applicable agreement.

Copyright and Image Use

Unless transferred through a written agreement, PaperCity Photography retains copyright in photographs and other original creative work.

Clients receive only the usage rights stated in their agreement or accompanying license. Images may not be sold, materially altered, entered into commercial advertising, submitted to artificial-intelligence training systems, or used beyond the granted license without written permission.

Copyright ownership does not by itself authorize PaperCity Photography to use identifiable client images publicly. Portfolio and promotional use will be governed by the applicable agreement or model release.

Website Content

The website’s photographs, videos, graphics, logos, text, layout, and other original material are owned by or licensed to PaperCity Photography and are protected by applicable intellectual-property laws.

You may not copy, reproduce, scrape, republish, sell, or commercially exploit website content without written permission.

Third-Party Services and Links

Our website may use or link to third-party scheduling, payment, gallery, map, social-media, and other services. We are not responsible for third-party availability, content, security, policies, or practices.

Disclaimers

We make reasonable efforts to keep website information accurate and the website available. Nevertheless, the website is provided on an “as available” basis to the extent permitted by law. We do not guarantee uninterrupted access or that every error or security risk can be eliminated.

Nothing in these terms excludes rights or remedies that cannot legally be waived.

Limitation of Liability

To the fullest extent permitted by applicable law, PaperCity Photography will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of or inability to use this website.

Liability relating to paid photography or studio-rental services is governed by the applicable written agreement and applicable law.

Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful use of the website, infringement of another person’s rights, or material violation of these terms.

Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute will be handled as provided in the applicable service agreement or, if none applies, by a court with proper jurisdiction in Massachusetts.

Changes

We may update these terms by posting a revised version with a new “Last updated” date. Changes apply prospectively unless applicable law requires otherwise.
